Welcome to Itasca Lawns. These Terms of Service ("Terms") govern your use of our lawn fertilizing and weed control services ("Services"). By engaging our Services, you agree to be bound by these Terms.
Services Provided
Itasca Lawns specializes exclusively in lawn fertilization and weed control services for residential properties within our designated service area (Grand Rapids, Cohasset, Deer River, MN, and surrounding areas as agreed upon). Our services include the application of fertilizers and approved herbicides according to our seasonal programs or agreed-upon schedules. We do not offer mowing, landscaping, aeration, dethatching, or other lawn maintenance services.
Service Agreement & Scheduling
Services are typically provided as part of a seasonal program outlined in your service agreement or estimate. We will make reasonable efforts to perform services according to the anticipated schedule, but timing may be adjusted due to weather conditions, product availability, or other factors. We will notify you of significant delays when possible. Access to the property is required on service days; locked gates must be unlocked, and pets secured.
Payment Terms
Payment terms will be specified in your service agreement or invoice. Options may include pre-payment for the season or payment due upon receipt of invoice after each application. Late payments may incur interest charges or suspension of service. Accepted payment methods will be indicated on the invoice.
Customer Responsibilities
- Ensure the service area is clear of obstacles, toys, furniture, pet waste, and debris before scheduled service.
- Provide access to the property, including unlocking gates.
- Keep pets and children off the treated lawn for the period specified on the service notification (typically until the application is dry).
- Inform Itasca Lawns of any specific concerns, sensitive areas (like vegetable gardens near the lawn edge), or known issues with the lawn prior to service.
- Follow watering recommendations provided after applications, if any.
Weed Control Guarantee & Expectations
Our weed control services aim to significantly reduce weed populations. While we strive for complete elimination, some stubborn weeds may require multiple treatments. Factors like weather, mowing height, and watering practices can affect results. Our program targets common broadleaf weeds and grassy weeds like crabgrass. Control of certain difficult weeds or specific grass types may not be guaranteed. We offer free service calls between scheduled visits if you notice significant weed resurgence within a reasonable timeframe (e.g., 14-21 days after treatment), subject to program terms.
Fertilization Expectations
Our fertilization program is designed to improve lawn color, density, and health over time. Results depend on existing lawn conditions, grass type, weather, and adherence to proper mowing and watering. Fertilizer provides nutrients but does not fix underlying issues like soil compaction, disease, or insect damage (which are outside our scope of service).
Liability
Itasca Lawns is not liable for damage to items left on the lawn (hoses, toys, etc.), unmarked sprinkler heads, invisible dog fences, or landscape lighting wires not installed to code depth. We are not responsible for pre-existing lawn damage, damage caused by factors outside our control (weather, disease, insects, improper mowing/watering), or damage if access is impeded. Our liability for any service-related damage caused by our direct negligence is limited to the cost of the specific application in question.
Cancellation Policy
You may cancel your seasonal program at any time by providing written notice (email acceptable). If you cancel mid-season after pre-paying, a refund will be issued for the prorated value of the remaining scheduled applications, less any discounts applied for prepayment. If paying per application, you are responsible for payment for all services rendered prior to cancellation.
Use of Products
We use professional-grade fertilizers and EPA-registered herbicides applied by trained technicians according to label instructions and state regulations. Information regarding specific products used can be provided upon request.
Modifications to Terms
Itasca Lawns reserves the right to modify these Terms at any time. We will notify existing customers of significant changes. Continued use of our Services after modifications constitutes acceptance of the new Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota.
